These Terms of Use ("Terms") apply to howtocancelgym.com (the "site"), operated by HowToCancelGym ("we", "us"). Please read them. They are short and written in plain English.
1. Accepting these terms
By using the site, including the letter generator, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the site.
2. Information only, not legal advice
Everything on the site is general information for educational purposes. It is not legal advice, and using the site, contacting us or generating a letter does not create an attorney-client relationship. We are not a law firm. For advice about your situation, talk to a licensed attorney or your state attorney general's consumer protection office.
3. No affiliation; trademarks
We are an independent guide. We are not affiliated with, endorsed by or sponsored by any gym, fitness club or brand mentioned on the site. Gym names and other trademarks belong to their respective owners. We use them only to identify the businesses we write about (nominative use), not to suggest any connection or endorsement.
4. No guarantees
We work to keep information accurate and show the date we last verified it, but gym policies, contracts and laws change. We don't guarantee that any information is complete or current, or that any cancellation will succeed. Your membership agreement and your gym's current policy control your situation, so always verify the details with your gym and your contract.
5. The letter generator
The letter generator is a free self-help template that runs in your browser. You decide what the letter says. You are responsible for its contents, for checking that it meets your agreement's requirements (such as notice method, address and deadlines), and for sending it and keeping proof of delivery. We don't send letters, contact gyms or act on your behalf.
6. "As is", no warranties
The site and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
7. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost money, fees, charges or data, arising from your use of (or inability to use) the site or the letter generator. Our total liability for any claim relating to the site is limited to the amount you paid us to use it in the 12 months before the claim. Because the site is currently free, that amount is $0. Some places don't allow certain limits, so some of these may not apply to you.
8. Indemnification
You agree to defend, indemnify and hold harmless HowToCancelGym from any claims, losses or expenses (including reasonable attorneys' fees) arising from your misuse of the site, your violation of these Terms, or the content of any letter or message you send.
9. Third-party links
The site links to gym websites, government sources and other third-party sites. We don't control them and aren't responsible for their content, accuracy or practices. Visiting them is at your own risk and subject to their terms.
10. Corrections
If you see an outdated policy, a wrong address, a broken link or any other error, email [email protected] with the page URL, what's wrong and, if possible, a link to the source. We review every request and update pages when we can confirm a change.
11. Changes to these terms
We may update these Terms from time to time. When we do, we'll change the effective date above. Continuing to use the site after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of the United States and of the state where the site operator resides, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
